  • Consultation with a Qualified Intermediary (QI): The process begins by consulting with a Qualified Intermediary, an essential third-party facilitator required for a 1031 exchange. The QI assists in preparing the necessary documentation and ensures compliance with IRS regulations.
  • Identification of Replacement Property: Within 45 days of selling the relinquished property, the investor must identify potential replacement properties. The identification must be done in writing and submitted to the QI. Investors can identify up to three potential replacement properties, regardless of their value, or any number of properties as long as their total fair market value doesn’t exceed 200% of the relinquished property’s value.
  • Sale of Relinquished Property: The relinquished property is sold. The sale proceeds are transferred to the QI, who holds the funds until the replacement property is acquired.
  • Identification Deadline: The investor must identify replacement properties within 45 days of selling the relinquished property. This is a crucial deadline, and failing to identify within this period can disqualify the exchange.
  • Acquisition of Replacement Property: Once the replacement property has been identified, the investor has 180 days from the sale of the relinquished property to acquire it. The QI handles the funds to purchase the replacement property directly.
  • Completion of the 1031 Exchange: The 1031 exchange is completed when the replacement property is acquired within the 180-day period. The investor now owns a new property without incurring immediate capital gains tax on the profit from the sale of the relinquished property.
